Terms and Conditions

GoneXFishing is a digital platform that connects Travelers (“Travelers”) with independent, third-party fishing lodge/resort/guide service providers of work exchange opportunities, listings, and experiences (“Hosts”). Throughout this Agreement, the terms “users,” “user,” “you,” or “your” collectively refer to both Hosts and Travelers who access or use the GoneXFishing Platform.

Please read these Terms and Conditions and other applicable terms and documents referenced herein (collectively, the “Agreement” or “Terms”) before using the GoneXFishing website (“Platform”) provided by M.J. Pescador Ltd. (hereafter referred to as “GoneXFishing” or “we” or “us” or “our”), since this Agreement contains legally binding terms.

Please read these Terms and any additional terms applicable to your use of the Platform before using it. By accessing, using, or attempting to use the GoneXFishing Platform in any capacity, you acknowledge that you accept and agree to be bound by these Terms. If you do not agree, do not access GoneXFishing or utilize the GoneXFishing Platform. These Terms expressly supersede prior agreements or arrangements with you regarding the use of the Platform.

  1. Changes to Terms and Platform

Because we strive to improve the Platform and our services, our Terms and Platform practices may change from time to time. GoneXFishing reserves the right to change or modify these Terms at its discretion at any time. GoneXFishing will notify you of such changes by updating the terms on the Platform and modifying the “last revised” date displayed on this page. In the event of a material change to the Platform, we shall notify you via message or by means of a prominent notice on the Platform.

Any modifications or changes to these Terms will become effective upon publication on the website or release to users. By continuing to use the Platform following such changes, you agree to be bound by such changes. If you do not agree to any changes to these terms, you must stop using the GoneXFishing Platform immediately.

  1. The Platform, description, and release

Platform and description: The Platform provides an online service enabling travelers to work in fishing lodges and resorts in exchange for board and lodging and the chance to host or be a guest of fishing trips globally. Hosts are able to list work exchange opportunities (“Listing”), and Travelers can search Host listings, board, and access Host destinations in return for services as described in the Listing. For example, to help Travelers find a Host, we will provide them with Listings and/or profiles of Hosts. These results are based on information provided by Travelers, such as their needs, geographical location, and specialty areas. They may also be based on other criteria (including, for example, Host availability, past selections by and/or ratings of Hosts by Travelers or by other Users, and past experience of Travelers.

The Platform may also include payment processing, marketing, sales, scheduling, and any other services as may be provided or requested. Any information or content that you obtain or receive from us, our employees, contractors, partners, sponsors, advertisers, licensors, or otherwise through the Platform (“GoneXFishing Content”) is for informational and scheduling purposes only. Host listing and exchange management with Travelers occurs directly between users.

Insurance: GoneXFishing does not provide or offer insurance coverage to users of the Platform. Users are solely responsible for obtaining their own insurance coverage, including but not limited to travel insurance, liability insurance, and any other necessary coverage related to their activities on the Platform.

Neutral platform and release: GoneXFishing is a neutral platform and does not own, create, sustain, manage, control, list, or offer any Listing, Host profile, organize any travel, intermediate exchange relationships, or is responsible in any way for the arrangements made between users of the Platform. Users are solely responsible for the Listing posted by them. GoneXFishing acts as a neutral intermediary platform provider enabling connections. GoneXFishing does not act as a travel agency, employment agency, or insurance company or operate in any similar capacity. GoneXFishing does not act as an agent in any capacity for a User of the Platform. 

GoneXFishing does not make any representations or warranties of any kind with respect to any User. Users are solely responsible for evaluating and determining the suitability of another user on the Platform. GoneXFishing is not responsible for any non-performance or breach of any contract entered into between Users of the Platform. GoneXFishing cannot and does not guarantee that the concerned User(s) will perform any transaction concluded through the Platform.

GoneXFishing shall not be liable for the acts, breaches, or negligence of any User or for any personal injuries, death, property damage, or other damages or expenses resulting from services provided to Users. Any dispute between users will be between the respective Host and Traveler, and we will not be a party to that dispute. We are not a party to any engagement between users, and we are in no way responsible for the acts or omissions of any user thereunder. However, at our sole discretion, if you are unable to resolve a dispute with another user, we may use commercially reasonable efforts to mediate and arrive at a mutually agreed-upon resolution.

However, we may take actions such as limiting the visibility of your account, listing or suspending your account if we determine that you are acting against the policies herein in this Agreement and other GoneXFishing agreements incorporated herein by reference, including all the policies and terms on our Platform.

You release GoneXFishing from liability for any issues under privately made exchange agreements to the maximum extent permissible legally unless gross negligence by specific employees is directly proved.

  1. Account; registration and acceptance 
  2. User Account: In order to access and use most aspects of the Platform, you must register for and maintain a user account (“Account”). Subject to the Terms herein, certain portions of the Platform are available to Platform visitors, including those portions before the creation of an account.

We reserve the right to revoke the privileges of the account or access to or use of the Platform and those of any and all linked accounts without warning if, in our sole discretion, false or misleading information has been provided in creating, marketing, or maintaining your Profile or account.

  1. Eligibility: To register for an Account or use the Platform, you must, and hereby, represent that you will use the Platform as intended only. You also represent that you are either a legal entity or an individual who is 18 years or older (or has otherwise reached the age of majority in the jurisdiction in which you conduct business) in each case who can form legally binding contracts.
  1. Registration and acceptance: Account registration requires you to submit certain personal information, such as your name, email address, location information, and/or mobile phone number. You agree to maintain accurate, complete, and up-to-date information in your Account. 

We may also require you to provide additional optional information about you and your preferences from time to time, which is not a compulsory requirement to register for a user account but may be helpful to GoneXFishing in improving and providing you with a more customized user experience when using the Platform. 

GoneXFishing reserves the right to decline a registration to join GoneXFishing for any lawful reason.

  1. Usernames, passwords, and account security: Each user who uses the Platform must register for their own Account. When you register for an Account, you may be asked to choose a username and password for the Account. You are responsible for all activity that occurs under your Account, and you agree to maintain the security and secrecy of your Account username and password at all times. You agree to notify us immediately if you suspect or become aware of any unauthorized use of your Account or any unauthorized access to the password for any Account. You further agree not to use the Account or log in with the username and password of another User of the Platform if (a) you are not authorized to use it or (b) the use would violate the Terms. You hereby acknowledge and agree that GoneXFishing will not in any way be liable to you for any loss caused by unauthorized access to and use of your account.
  1. Verification and background checks: GoneXFishing may conduct background checks on users or require additional documents to verify their identity; however, we do not guarantee the accuracy of any user’s identity on the Platform or their claims to be who they claim to be.
  1. Intellectual property rights, license, and restrictions
  2. Intellectual property rights: This platform is controlled and operated by GoneXFishing, and all material on the Platform, including but not limited to software, images, illustrations, user interface, text, scripts, graphics, audio clips, video clips, and other interactive features (collectively the “GoneXFishing Content”), made available to you on the Platform. GoneXFishing owns logos, trademarks, and service marks contained herein. Other service marks, logos, and names on this Platform are the property of their respective owners. Any use of the Platform or the contents made available to you on the Platform other than as specifically authorized herein without our prior written permission is strictly prohibited and will terminate the license granted herein. Such unauthorized use may also violate applicable laws, including, without limitation, copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these Terms shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication, or otherwise. This license is revocable by GoneXFishing at any time without notice and with or without cause.
  1. License and restrictions: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to access and use the Platform subject to the Terms of this Agreement. Any rights not expressly granted herein are reserved by us.

You may not: (i) remove any copyright, trademark, or other proprietary notices from any portion of the Platform; (ii) reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Platform except as expressly permitted by us; (iii) decompile, reverse engineer or disassemble the Platform except as may be permitted by applicable law; (iv) link to, mirror or frame any portion of the Platform; or (v) cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Platform or unduly burdening or hindering the operation and/or functionality of any aspect of the Platform.

  1. Additional terms for Host

Listings and descriptions: As a Host, you affirm ownership over your listings. You agree that listings must accurately showcase offered participation exchange amenities, expectations, offerings, and visitor experiences. False, intentionally misleading content risks sanctions. 

To create a Listing, you will be asked a variety of questions about the lodge to be listed as described below. You also represent that all information provided by you in the Listing is true and accurate. As a Host, if you cannot fulfill a Listing request or provide false information about your Listing, we may suspend or disable your account.

When creating a Listing through the Platform, you must:

  1. provide complete and accurate information about the Listing and services you are offering, including, but not limited to, the location, accessibility, size, features, and duration of availability of the lodge, and related expectations and rules of the Listing,
  2. disclose any deficiencies, difficulties, and restrictions inherent to the place and requirements that a Traveler needs to meet in order to be able to book the Listing, such as the Traveler’s minimum age, language proficiency, or physical size. Such requirements may also include certain eligibility requirements, such as requiring the Traveler to have valid travel documents, means of identification, proof of insurance, or a verified means of communication such as a phone number or email address.
  3. provide any other relevant information requested in order to complete a Listing on the Platform. After making a listing available on the Platform, you are responsible for keeping your Listing information updated at all times, including the availability of such Listing.

Booking. You understand and agree that once a Traveler books your lodge listing (“Booking”), you will honor any provisions of the Booking as described in your Listing. For example, you may not request the Traveler do any additional activity than in the Listing or otherwise materially change the terms of the Listing for that Booking.

Service fulfillment: You agree that by making a Listing, you will honor any booking request that meets your requirement as described in your Listing. And as such, you represent that all information provided by you in the Listing must be true and accurate.

Assumption of risk: Though we encourage a respectful and seamless user experience amongst users, we will not be held responsible for the conduct of any Traveler or other users you come in contact with. You understand that providing services as a Host comes with inherent risk, and you agree to use caution and apply common sense in all interactions with other users. 

You understand and agree that GoneXFishing does not, and cannot, confirm that each User is who he/she/they claim to be. You assume all risks associated with Users with whom you come into contact. If you have any disputes or issues with any User, you agree to pursue any remedies directly with the applicable User, and you release GoneXFishing, its subsidiaries, and their respective employees, directors, and agents from all claims, demands, and damages of every kind (actual and consequential and direct and indirect) known and unknown, suspected and unsuspected, disclosed and undisclosed, to the fullest extent permitted by law.

  1. Additional terms for Travelers
  1. You understand that you are responsible for selecting and choosing Hosts you want to engage and interact with. GoneXFishing makes commercially reasonable efforts to ensure that Hosts only participate in the Platform if they meet the minimum required by law to provide the services they offer.
  2. You understand that you are solely responsible for evaluating and determining the suitability of any Host and their exchange terms and conditions. We are not responsible for the security and safety of the Host location or amenities provided by the Host.
  3. You understand that we are not responsible for any non-performance or breach of any contract entered into between Users of the Platform.
  4. You understand that we do not guarantee, nor do we warrant or represent, that the information displayed in a Listing by a Host is accurate or that it belongs to the Host who supplied it.
  5. you will honor the agreement between you and the Host as described in the Host Listing requirements.
  6. You understand that you have to leave the lodge provided by the Host no later than the date and time specified by the Host in the Listing or comply with other mutually agreed arrangements between you and the Host. If you stay in the lodge beyond the agreed period of checkout without the consent of the Host, you will no longer be licensed to remain in the lodge, and the Host will have the right to request your departure in a manner consistent with applicable laws.
  7. Travelers who are also fishermen have the option to host fishing trips or participate in trips hosted by other Travelers. GoneXFishing provides the Platform to enable these connections but does not participate in making arrangements. Travelers are solely responsible for evaluating potential trips and trip partners and determining participation. GoneXFishing is not responsible for the security, safety or quality of any hosted fishing trips resulting from Platform introductions.
  8. Damage to property or person: You understand that any and all damage, injury, or destruction to the lodge provided by the Host caused by you, the Traveler, shall be your liability.
  1. Membership, subscription fee, and terms

Membership fee: Users on the goneXfishing platform must purchase a paid membership subscription. By registering for membership on our platform, you agree to pay an annual subscription fee of $99 USD. This fee grants you access to all features and services provided by the platform for a period of one year from the date of subscription..

Payment terms: The subscription fee is payable in full at the time of registration and is non-refundable. Payment can be made using the available payment methods accepted on the platform.

Automatic renewal: Your membership subscription will automatically renew at the end of each annual billing cycle, unless you choose to cancel your subscription prior to the renewal date. By providing your payment information, you authorize us to charge the applicable subscription fee to your chosen payment method for the renewal term.

Cancellation Policy: You may cancel your membership subscription at any time, however, please note that there will be no refunds for any unused portion of your subscription period. Upon cancellation, you will retain access to the platform until the end of your current billing cycle, after which your access will be terminated.

No prorated refunds: We do not offer prorated refunds for canceled subscriptions. Regardless of the time of cancellation within your subscription period, you will not be entitled to a refund for any portion of the subscription fee already paid.

Modification of fees: We reserve the right to modify the subscription fee for future subscription periods. Any changes to the subscription fee will be communicated to you in advance, and you will have the option to accept the new fee or cancel your subscription before the renewal date.

Taxes: All subscription fees are exclusive of any applicable taxes, which will be added to the total amount due at checkout based on your location and the prevailing tax regulations.

Fee disputes: In the event of a dispute regarding subscription fees or charges, please contact our customer support team for resolution. We will make every effort to address and resolve your concerns in a timely manner.

  1. User Content and content ownership

Content you submit: Much of the content, such as photos, documents, queries, information, messages, and any other material or data (collectively “User Content”) on our Platform, are made available by users of the Platform and other third parties. Whether that content is posted publicly or sent privately, the content is the sole responsibility of the user who submitted it.

GoneXFishing features personal web pages or profiles, forums, bulletin boards, and other interactive features that allow users to post, submit, publish, display, or transmit content or materials to other users or other persons. GoneXFishing does not guarantee the accuracy, integrity, or quality of the opinions and advice posted on GoneXFishing by users. Your use of any user content provided on the Platform is at your own risk.

You also agree to only post user content to the Platform if you know you have the necessary rights to do so. By uploading user content, you represent and warrant that (a) you own or otherwise control all of the rights to such User content; (b) that the User content is accurate; (c) that the use of such submission does not violate this Agreement and will not cause injury to any person or entity, and (d) that you will indemnify GoneXFishing for all claims relating to such content.

Unless we indicate otherwise, by posting or submitting such User Content to the Platform, you grant GoneXFishing a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content, and the name submitted in connection with such content, throughout the world in any media now known or hereafter conceived. GoneXFishing and its affiliates are free to use any ideas, concepts, or know-how contained in Your Content for any purpose whatsoever, including, but not limited to, the right to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material for any purpose.

Monitoring your User Content: We may, but are not obliged to monitor the use of any feature made available to you for use from time to time. However, we still rely on users to inform us of any abuse or inappropriate behavior, in which case we may review specific content. If you feel you have been threatened, damaged, or abused in our community or via our communication systems, or if you believe any infringement of your rights may have occurred through the Platform, please contact us at info@gonexfishing.com. 

GoneXFishing is not in any way involved in any arrangements made between Users. Any postings on the Platform and the uploading of any photos, pictures, videos, animations, or other audio-visual material to the Platform by users of the platform does not constitute any form of recommendation, representation, endorsement, or arrangement by GoneXFishing. In particular, we have no control over and are not responsible for the truth or accuracy of any content, its compliance with any legal or regulatory requirement, or its quality or safety. Please contact GoneXFishing if you have any concerns about the content of any information seen on the Platform.

You also understand that any information posted via the Platform or other communication features made available to you on the Platform is the opinion of the person posting such User content or information. If you rely on the information posted, you do so at your own risk. Although we have rules for posting content, it is possible that our interactive features could be susceptible to misuse. We ask all Users to contact us in respect of any suspicion of misuse at info@gonexfishing.com. .

We reserve the right (but we are not obliged) to do any or all of the following:

  1. investigate a claim that any one or more items of content do not comply with the acceptable use rules set out in this Agreement or as may be determined in our sole discretion to remove or request the removal of the content;
  2. remove without notice any content that is abusive, illegal, disruptive, or that otherwise fails to conform with these Terms;
  3. terminate a user’s access to post content;
  4. monitor, edit, or disclose any content; edit or remove any content posted on GoneXFishing, regardless of whether such content breaches these Terms;
  5. suspend or terminate your access to the GoneXFishing Platform.
  1. User representation and acceptable use

You hereby represent, warrant, and agree that no materials of any kind submitted through your account or otherwise posted or shared by you through the Platform will be in violation of the rights of any third party, including but not limited to the copyright, trademark, publicity, privacy or other personal or proprietary rights.

Although we are committed to providing a safe user experience, we do not guarantee that the Platform, or any content in it, will be safe, error-free, or uninterrupted or that it will be free from bugs or viruses. From time to time, access to the Platform may be interrupted, suspended, or restricted, including because of a fault, error, unforeseen circumstances, or scheduled maintenance. We shall not be liable to you for any loss or damage that you may suffer as a result of the Platform being unavailable at any time for any reason.

You agree, undertake, and confirm that your use of the Platform we make available to you shall be strictly in accordance with the following binding guidelines:

  1. You shall not host, display, upload, modify, publish, transmit, update, or share any information that:
  1. belongs to another person and to which you do not have any right to make use of or promote an illegal or unauthorized copy of another person’s copyrighted content, such as providing links to them or providing information about them;
  2. is grossly harmful, harassing, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; or,
  3. is patently offensive to the online community, such as sexually explicit content or content that promotes obscenity, pedophilia, racism, bigotry, hatred, or physical harm of any kind against any group or individual or provides material that exploits people in a sexual, violent or otherwise inappropriate manner or solicits personal information from anyone;
  4. Involves the transmission of “junk mail,” “chain letters,” or unsolicited mass mailing or “spamming” or contains any trojan horses, worms, time bombs, cancelbots, easter eggs, or other computer programming routines that may damage, detrimentally interfere with, diminish the value of, surreptitiously intercept or expropriate any system, data or personal information;
  5. promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
  6. Provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses; contains video, photographs, or images of another person (with a minor or an adult);
  7. tries to gain unauthorized access or exceeds the scope of authorized access to the Platform or to profiles, blogs, communities, account information, bulletins, or other areas of the Platform or solicits pass-codes or personal identifying information for commercial or unlawful purposes from other users.
  8. interferes with another user’s use and enjoyment of the Platform or any other individual’s user and enjoyment of similar services;
  9. refers to any Platform or URL that, at our sole discretion, contains material that is inappropriate for the Platform or contains content that would be prohibited or violate the letter or spirit of these Terms.
  10. You shall not attempt to manipulate or misuse the Ratings system.
  1. You shall not use any “deep-link,” “page-scrape,” “robot,” “spider,” or other automatic devices, program, algorithm, or methodology, or any similar or equivalent manual process to access, acquire, copy, or monitor any portion of the Platform or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Platform or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Platform.
  2. You shall not abuse any discounts, coupons, or promotions by harvesting or farming discounts or coupons.
  3. You shall not attempt to encourage, permit, or allow other users of the Platform to do anything that is prohibited or anything that violates the terms of this agreement.
  4. You shall not use the Platform for fraudulent or illegal purposes or in connection with a criminal offense or any unlawful activity.
  5.  You shall not probe, scan, or test the vulnerability of the Platform or any network connected to the Platform nor breach the security or authentication measures on the Platform or any network connected to the Platform. You may not reverse look-up, trace, or seek to trace any information on any other user to the Platform or any other customer, including any account on the Platform not owned by you, to its source, or exploit the Platform or information made available or offered by or through the Platform, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided for by GoneXFishing.
  6. You shall not attempt to obtain another user’s account username, password, or other security information.
  7. You shall not conceal your true I.P. address or otherwise misrepresent or impersonate your identity.
  8. You agree not to use any device, software, or routine to interfere or attempt to interfere with the proper working of the Platform, any transaction being conducted on the Platform, or any other person’s use of the Platform.

You shall not use our Platform for any other purpose than GoneXFishing’s intended purpose as described herein.

The content you access: It is possible that other users (including unauthorized users or “hackers”) may post or transmit offensive or obscene materials on the Platform and that you may be involuntarily exposed to such offensive or obscene materials. It is also possible for others to obtain personal information about you due to your use of the Platform, and the recipient may use such information to harass or injure you. We do not approve of such unauthorized uses, but by using the Platform, you acknowledge and agree that we are not responsible for the use of any personal information that you publicly disclose or share with others on the Platform. Please carefully select the type of information that you publicly disclose or share with others on the Platform.

  1. Your safety; interaction with other users

The Platform allows you to interact with other users, either in person or online. Although GoneXFishing strives to encourage a respectful member experience, GoneXFishing is not responsible for the conduct of any member on or off of the Platform that we provide. You agree to use caution in all interactions with other members, particularly if you decide to communicate off the Service or meet in person.

By using the Platform, you understand and agree that we have the right to monitor your access and use of the Platform to operate the Platform, ensure compliance with these Terms, and comply with applicable law or other legal requirements. 

We reserve the right but are not obligated to remove or disable access to any content at any time and without notice, including, but not limited to, if we, at our sole discretion, consider any content to be objectionable or in violation of these Terms. We also have the right to investigate violations of these Terms or conduct that affect the Platform. We may also consult and cooperate with law enforcement authorities to prosecute users who violate the terms herein.

  1. Non-discrimination policy

GoneXFishing prohibits discrimination against any User or other third party based on race, religion, national origin, disability, sexual orientation, sex, marital status, gender identity, or any other characteristic protected under applicable law. GoneXFishing wants all of our users to feel safe and welcome, and we do not tolerate any conduct that we determine to be discriminatory.

  1. Violations and reporting violations

Users of the Platform may receive a warning to their account for violations of any of these Terms or for any user misconduct reported to us. A warning may be sent to the email address attached to the user’s account. Warnings do not limit account activity but can lead to the user’s account being suspended or becoming permanently disabled based on the severity of the violation.

If you come across any content that may be in violation of these Terms, you should report it to us immediately so that we can take appropriate actions. All cases are reviewed by our team. To protect individual privacy, the results of the review may not be shared, and you understand and accept that except as required by law, we are not obligated to take action in response to any report. You can review our Privacy Policy for more information on our disclosure practices.

  1. Copyright infringement notification

GoneXFishing respects the intellectual property of others and asks its content partners and those posting to the GoneXFishing Platform to do the same. GoneXFishing’s Platform may not be used to transmit, retransmit, distribute, post, or store any material that is in violation of any rights of any person, including rights protected by copyright, trade secret, patent, or other intellectual property or similar laws or regulations.

GoneXFishing has established procedures for enforcing this statement. So, if you believe that your copyrighted work has been copied and is accessible on the GoneXFishing’s Platform in a way that constitutes copyright infringement, please reach out to us. 

Please note that any person who knowingly misrepresents to GoneXFishing that material is infringing shall be liable to GoneXFishing and/or the alleged infringer for any damages (including costs and attorneys’ fees) suffered or incurred by GoneXFishing and/or the alleged infringer as a result of GoneXFishing’s reliance on such misrepresentation and removing or disabling access to such material. ii) Similarly, any person who knowingly misrepresents to GoneXFishing that the material was removed or access blocked by mistake or misidentification shall be liable to GoneXFishing and/or the copyright owner or its authorized licensee for any damages (including costs and attorneys’ fees) suffered or incurred by GoneXFishing and/or the copyright owner or its authorized licensee as a result of GoneXFishings’ relying on such misrepresentation and replacing such removed or blocked material.

  1. Ratings and reviews

GoneXFishing provides a rating and review system with the purpose of providing helpful and informative feedback to other users. Users of GoneXFishing may use the system to provide ratings and reviews based on their experiences with other users of the Platform, such as Hosts and Travelers. By submitting a rating or review, users agree to provide honest and accurate feedback based on their personal experiences.

Users are responsible for ensuring that their ratings and reviews are accurate, truthful, and based on their own experiences. Users should provide constructive and objective feedback that is relevant to the specific interactions or transactions that occurred through the Platform.

  1. Consent to electronic transactions, communication, and disclosures

To the fullest extent permitted by law, these Terms and any other agreements, notices, or other communications from GoneXFishing to you regarding our Platform being offered (“Communications”) may be provided to you electronically, and you consent and agree to receive Communications in an electronic form. Electronic Communications may be posted on the pages within the GoneXFishing Platform and/or delivered to your email address. 

Also, you expressly consent to be contacted by us, our agents, representatives, affiliates, or anyone calling on our behalf for any and all purposes at any telephone number, physical or electronic address you provide, or any other place where you may be reached. You agree we may contact you in any way, including SMS messages (including text messages), calls using prerecorded messages or artificial voice, and calls and messages delivered using an auto telephone dialing system or an automatic texting system. Automated messages may be played when the telephone is answered, whether by you or someone else.

Some links on the Platform may allow you to leave the Platform. The linked websites or resources are not in any way under our control, and we are not responsible for the contents of any of such linked websites or any link contained in a linked website or any changes or updates to such website.

When accessing and/or using the Platform and the Services we offer, we may obtain certain information about you, or you may be required to provide certain information to us. All uses of your information will be treated in accordance with our Privacy Policy, which herein forms an integral part of these Terms. Please refer to our Privacy Policy for information on how we collect, use, and disclose information from our users.

THE PLATFORM, WITHOUT LIMITATION, THE WEBSITE, APP, AND ALL CONTENT AND MATERIALS ACCESSED THROUGH OR VIA THE GONEXFISHING PLATFORM ARE PROVIDED “AS IS, ” “AS AVAILABLE, ” AND “WITH ALL FAULTS. “

WHILST GONEXFISHING USES REASONABLE EFFORTS TO CORRECT ANY ERRORS OR OMISSIONS ON THE PLATFORM AS SOON AS PRACTICABLE ONCE THEY HAVE BEEN BROUGHT TO GONEXFISHING’S ATTENTION, GONEXFISHING MAKES NO PROMISES, GUARANTEES, REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER (EXPRESS OR IMPLIED) REGARDING THE PLATFORM OR ANY PART OR PARTS THEREOF, ANY CONTENT, OR ANY LINKED SERVICES OR OTHER EXTERNAL SERVICES. GONEXFISHING DOES NOT WARRANT THAT YOUR USE OF THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE OR ANY PART OR PARTS THEREOF, THE CONTENT, OR THE SERVERS ON WHICH THE PLATFORM OPERATES ARE OR WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. GONEXFISHING DOES NOT WARRANT THAT ANY TRANSMISSION OF CONTENT UPLOADED TO THE PLATFORM WILL BE SECURE OR THAT ANY ELEMENTS OF THE PLATFORM DESIGNED TO PREVENT UNAUTHORIZED ACCESS, SHARING, OR DOWNLOAD OF CONTENT WILL BE EFFECTIVE IN ANY AND ALL CASES, AND DOES NOT WARRANT THAT YOUR USE OF THE PLATFORM IS LAWFUL IN ANY PARTICULAR JURISDICTION.

GONEXFISHING AND ITS SUBSIDIARIES, AFFILIATES, SUCCESSORS, AND ASSIGNS, AND THEIR RESPECTIVE EMPLOYEES, AGENTS, DIRECTORS, OFFICERS, AND SHAREHOLDERS, SPECIFICALLY DISCLAIM ALL OF THE FOREGOING WARRANTIES AND ANY OTHER WARRANTIES NOT EXPRESSLY SET OUT HEREIN TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING WITHOUT LIMITATION ANY EXPRESS OR IMPLIED WARRANTIES REGARDING NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

WHERE THE LAW OF ANY JURISDICTION LIMITS OR PROHIBITS THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES AS SET OUT ABOVE, THE ABOVE DISCLAIMERS SHALL NOT APPLY TO THE EXTENT THAT THE LAW OF SUCH JURISDICTION APPLIES TO THIS AGREEMENT.

  1. Limitations of liability

GoneXFishing and its officers, directors, employees, suppliers or agents, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to Platform interruption, and whether in tort, including without limitation negligence, contract or otherwise) in connection with these Terms or the Platform in any way (including in connection with the use, inability to use or the results of use of the Platform, any website linked to the Platform or the material on such Platforms, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing the Platform or your downloading of any material from the Platform or any website linked to the Platform). 

In no event will GoneXFishing’s total liability arising out of or in connection with these Terms or from the use of or inability to use the Platform exceed the lesser of the total amounts you have paid to GoneXFishing during the six months immediately preceding the event(s) giving rise to such liability or fifty dollars ($50), if you have not had any payment obligations to GoneXFishing, as applicable. The exclusion and limitations of damages set forth above are fundamental elements of the basis of the bargain between GoneXFishing and you.

You agree that if you are dissatisfied with any portion of the Platform, the services we offer, or with this Agreement, your sole and exclusive remedy is to discontinue the use of the Platform and the services that we offer.

  1. Indemnification

You agree that as a condition of use of the Platform, you will indemnify, defend, and hold harmless GoneXFishing, its officers, directors, employees, agents, licensors, and suppliers (collectively, the “Service Providers”) from and against any and all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from your use of the Platform or any product, including any claims alleging facts that if true would constitute a violation of these Terms or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Platform using your account.

  1. Term and Termination

This Agreement shall commence on the day you first access the Platform and continue in full force and effect for as long as you use the Platform or until terminated by either party.

We may terminate your access to all or any part of the Platform at any time, with or without cause, effective upon notice thereof to you (provided that, if we determine there may be an immediate threat to us, we may terminate such access without notice). You may also terminate your use of the Platform and cancel your Account at any time by completely ceasing to use the Platform.

Upon termination notice from us, the user will no longer access (or attempt to access) the Platform. However, all provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, Intellectual property, copyrights, trademarks, disclaimers, and limitations of liability.

  1. Choice of law and jurisdiction

This Agreement and any disputes or claims arising out of or in connection with them, including non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of the Republic of Cyprus.

  1. Waiver

No waiver of any of the provisions of this Agreement will constitute a continuing waiver unless otherwise expressly so provided in writing. The failure of either Party to enforce any of the provisions of this Agreement at any time will in no way be construed to be a present or future waiver of such provisions. We do not guarantee that we will pursue legal actions against all breaches of this Agreement.

  1. Severability

If any term of these Terms is determined as invalid or unenforceable by a court of law, such term shall be deemed severable without affecting the validity of the remaining term.

  1. Force majeure

Notwithstanding the other provisions of this Agreement, if GoneXFishing is in good faith prevented from performing its obligations under this Agreement because of an event beyond its control, including without limitation, any act or omission of our third-party partners, war (declared or undeclared), terrorism, explosions, pandemics, and acts of God like an earthquake, flood, hurricanes, tornadoes, and other natural calamities, GoneXFishing will be relieved from performing its obligations provided that, it will take all reasonable steps to promptly remedy the cause of such delay or failure if it is in its power to do so.

  1. Entire Agreement

These Terms comprise the entire agreement between you and us relating to your access to and use of the Platform, Platform Content, and any product you have purchased on the Platform and supersede any and all prior discussions, agreements, and understandings of any kind. Except as otherwise provided herein, these Terms are intended solely for the benefit of the parties and are not intended to confer third-party beneficiary rights upon any other person or entity.
